Lineup Terms of Service

These terms apply when you use https://lineupapp.nl. The short version is: use Lineup honestly and safely, respect other people, keep the rights to your content, and do not interfere with the service or use other people's data improperly.

1. Lineup and acceptance

Lineup is operated by Carlos Montenegro, sole proprietorship, KVK 96085819, Tuigerstraat 60, 1033 PH Amsterdam, the Netherlands (Lineup, we). Contact: https://lineupapp.nl/contact or carlos.montenegrovela@gmail.com.

By creating an account or using Lineup's interactive features, you agree to these terms. Lineup is intended for adults aged 18 or over. If you use Lineup for an organisation, you confirm that you can bind that organisation for the relevant use.

In these terms, a Space is a distinct organiser-managed area within Lineup, an Organiser is the person or organisation responsible for that Space, a Member is a person who is invited, applies, joins or otherwise participates in it, and personal data used for a Space is Space Data.

The Privacy Notice explains how personal data is handled; it is information, not part of these contractual terms. Organisers for whom Lineup processes data through a Space must also accept the Organiser Data Processing Terms (DPA). Those processing terms also apply if you use a private workspace for professional or business purposes and data-protection law makes you controller of its content. An organiser-specific addendum may contain additional commercial or operational arrangements.

For data processing, the DPA takes priority, except that an addendum may record more specific lawful instructions or stronger protections for an Organiser. An organiser-specific addendum takes priority for that Organiser's other special arrangements. These Terms control everything else.

2. The service

Lineup is an online service for separately organiser-managed Spaces, communities and professional connection. It may provide tools for membership, profiles, discovery, communication, collaboration, records and administration, together with other functions added as the service develops. Available functions, integrations and layouts may change.

Each Organiser runs its own Space and decides its purpose, participation rules and membership. A Member may choose to join more than one Space, but each Space remains separately managed by its own Organiser. Lineup is not an employer, casting agency, representative, background-check service or party to arrangements between Members. You decide whether and how to meet, work with or contact another person.

3. Accounts and acceptable use

Use your own email address, provide information you are entitled to use and protect your sign-in codes. You are responsible for activity through your account unless you promptly report unauthorised access.

You must not:

  • impersonate someone, misrepresent an affiliation or provide unlawful or deliberately deceptive information;
  • harass, threaten, discriminate against or exploit another person;
  • scrape, harvest, sell or build an external database from Lineup profiles, Spaces, communications or private records;
  • send spam or treat a profile, connection, saved record or communication tool as automatic permission for marketing;
  • access or attempt to access another account, private Space, hidden field or restricted system;
  • bypass security or visibility controls, probe the service without written permission, introduce malicious code, overload the service or interfere with its operation;
  • copy, reverse engineer, resell, white-label or commercially exploit the service except where mandatory law permits or Lineup agrees in writing; or
  • use Lineup or information obtained through it unlawfully or in a way that infringes another person's privacy, intellectual property or other rights.

Lineup may investigate suspected misuse and may remove content, restrict features, suspend or terminate access where reasonably needed for security, law, protection of others or a material breach. We may preserve relevant records and cooperate with valid legal requests. Immediate action may be taken where reasonably needed.

4. Your content and other people's information

You keep ownership of content you provide. You give Lineup a limited, non-exclusive permission to host, copy, process, transmit and display it only as needed to provide, secure and support the service as described in the Privacy Notice. For Organiser-controlled data, Lineup may exercise this permission only to follow the Organiser's documented instructions under the DPA; it creates no independent purpose or reuse right. Lineup may use service information that has been anonymised or aggregated so that it does not identify individuals to operate and improve the product. This permission ends when the content or account is deleted, except for protected backups, another person's separate record and lawful retention.

You are responsible for having the right to provide your content and any details you enter about another person. Controller-managed private records must be kept accurate, secure and lawful; you must give any information required by law, respect rights and requests not to be contacted, and not assume that a saved record creates marketing consent. Where data-protection law makes you controller for professional or business records, Lineup processes them under the Organiser Data Processing Terms.

If your intentional unlawful use of Lineup causes a third-party claim or documented, reasonably incurred direct cost, you are responsible for the loss you caused to the extent permitted by law. This does not apply to ordinary good-faith mistakes, indirect losses or matters caused by Lineup, and ordinary legal defences remain available.

5. Organisers

An Organiser is controller for the personal data used for its Space and decides the Space's purposes, participation rules, membership and lawful use of that information. Lineup acts as processor for that Space Data under the Organiser Data Processing Terms.

Where an Organiser makes a Space discoverable, people using Lineup may find it and choose to join. Browsing shares no personal data with the Organiser and does not make the person a Member. Before joining, Lineup shows what information will be shared. Once the person confirms, that information becomes separate Space Data for that Space; its Organiser is controller and Lineup acts as processor. Nothing is transferred from another Space. For the limited data needed to operate accounts and the service, Lineup acts as controller only for its own service-administration purposes. This does not give Lineup ownership or independent use rights over Space Data.

If an Organiser intentionally provides unlawful data or instructions, or intentionally fails to provide a required notice, and this causes Lineup a third-party claim or documented, reasonably incurred direct cost, the Organiser is responsible for the loss it caused to the extent permitted by law. This does not apply to indirect losses or matters caused by Lineup, and ordinary legal defences remain available.

6. Ownership, feedback and service changes

Lineup owns its software, design, name, logo and general improvements. Using the service gives you a limited, revocable right to use the available service for its intended purpose; it does not transfer service ownership or source-code rights. Organiser and client brands remain theirs.

If you voluntarily provide an idea or feedback, Lineup may use it without restriction or payment, provided this does not give Lineup ownership of your existing content or brand.

Lineup may add, change or remove features and technical infrastructure where reasonably needed to operate, secure, improve or scale the service. We do not promise that a particular feature, integration or layout will remain available. These change rights do not restrict mandatory consumer rights concerning conformity, remedies, notice or termination. Where a separate signed agreement expressly promises something different, that agreement controls.

7. Availability, risk and liability

Lineup is provided on an as-is and as-available basis. We work to keep it useful and secure but do not guarantee uninterrupted availability, error-free operation, permanent storage, particular results, introductions, work opportunities or another user's identity or conduct. Keep your own copy of information that is important to you.

To the fullest extent Dutch law permits, Lineup is not liable for indirect, consequential or lost-profit damage. Lineup's total liability arising from the service is limited to the amount paid for it in the twelve months before the circumstance giving rise to the claim, or €100 if nothing was paid.

Nothing in these terms limits liability or rights that cannot legally be limited, including liability for intentional misconduct or deliberate recklessness, death or personal injury where applicable, and mandatory data-protection and consumer rights. Any liability under an Organiser DPA or addendum is subject to this section to the fullest extent permitted by law.

8. Leaving, suspension and termination

You can leave one Space without deleting your account. Other Spaces, private records and Organiser roles remain. You may also delete the full account; an Organiser must first delete or transfer each Space it controls so it is not silently removed for its Members.

Lineup may suspend or end an account or Space for the reasons in section 3, if continued service would create legal or security risk, or if the service is discontinued. Mandatory consumer notice and remedy rights remain unaffected. Account holders should use available export options before deleting an account. Organiser return and deletion rights are governed by the DPA and any applicable addendum.

Sections that logically continue—including ownership, responsibility, liability, law and accrued rights—survive termination.

9. Changes, law and contact

Lineup may update these terms for legal, security, product-improvement or operational reasons. If a change negatively affects an existing consumer's access or use beyond what is necessary to maintain conformity, we will give reasonable advance notice in a form the consumer can keep and allow termination before the change takes effect, except where law permits otherwise. Other material changes will be sent or shown directly before taking effect where reasonably possible. A version incorporated into a signed Organiser addendum changes only as that addendum and the DPA allow.

Dutch law governs these terms. Disputes go to the court competent under applicable law; where a valid choice of court is permitted, the competent court in Amsterdam applies. Mandatory consumer protections remain unaffected.
